It is important that you decide upon and instruct a lawyer to advise you in relation to your divorce at the earliest possible stage. Obviously, there will be a huge impact on your daily life once the decision is made to begin divorce proceedings. At Henry Hyams, our family law team will do what we can to minimise the disruption.

To petition for divorce you must have been married for at least a year. The only ground for divorce is that there has been the irretrievable breakdown of marriage which you must prove through 1 of 5 facts:

• Unreasonable behaviour
• Adultery
• Desertion
• Two years separation by consent
• Five years of separation

There are pros and cons to using some of these facts. We will listen to the circumstances of your case and advise you of your options, the divorce process and any divorce costs involved.

As of April 2022, new legislation introduced a new ‘No-Fault Divorce‘ option.
