Child Care Law
When social workers become involved with a family it is tough. Our child care lawyers have developed their experience and knowledge within a whole range of social care cases over a number of years. We will do all that we can to make sure you have the best possible chance of success in your case.
If possible you should make contact with us at the earliest opportunity. It always helps if we can be involved in a case from the outset. However, at Henry Hyams we are confident in our ability to provide support, advice and representation no matter what stage your case has reached. It may be that you have just had your first ever contact with a social worker, or that there has been ongoing involvement for some time; perhaps your child has recently suffered a serious injury or possibly abuse: no matter what it is, you will feel better once you know that you have the support of our team.
We can advise you how to respond to your specific situation and where necessary will we attend meetings or court hearings with you so that you understand what is being asked of you; consider whether this is fair for you and your children and advise you upon the best action to take.
What we can offer
There are so many different possible issues that are handled by our child care team it is difficult to provide a summary of all the situations that we can assist you with. Below is a list of some of the services that we provide.
Urgent advice for parents and family members who have had children removed from their care by the police.
Attendance at emergency court hearings with parents or family members who have been told a case is to be put before court that day in respect of the children of the family (Emergency Protection Orders).
Advice for parents and family members following initial enquires by social workers or the police.
Advice upon the best way to approach Child Protection Case Conferences, Strategic Planning or Review meetings.
Attend and support parents and family members at Public Law Outline Meetings (PLO).
Advise and represent parents or family members who have been informed that an application is being made to the court for their children to be made the subject of Care Orders, Supervision Orders or Child Assessment Orders.
Advise family members who have not been invited to attend court upon what options are available to them including the options to seek assessments or specific court orders.
We can advise parents or family members wherever they may be in England and Wales but we pride ourselves in our knowledge of how local courts and local authorities operate. The majority of our cases come from Leeds City Council, Bradford Metropolitan District Council, City of York Council, North Yorkshire County Council, Kirklees Council and Calderdale Council. We have solicitors appearing before the courts in Leeds on a daily basis and before other local courts almost as often.
Child Care law is one of the only areas of law where free legal advice through public funding is available to parents or carers of children if court proceedings are being considered (through PLO meetings) or have been taken. For other family members funding may also be available.
